You can solve this by using a heartbeat tunnel as then the tunnel is disabled when the heartbeats stop. The primary reason for requiring static tunnels to be up comes from the history that we used to get abuse reports from the next owner of the IPv4 address. Remember that SixXS is getting old and back then people didn't have 24/7 connectivity. PPP was what is in use back then and IP addresses where re-used. Firewall software would come up with all kind of hack attempt warnings when they saw protocol 41 traffic and abuse reports sometimes where even auto generated. To avoid this we created the heartbeat protocol. Thus for your case, I'd suggest to use that.
